1. Introduction

Welcome to dubaifotographer.com (“Company”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern the use of our website and all photography, videography, editing, drone, and related services provided by the Company throughout the United Arab Emirates.

By requesting a quote, confirming a booking, making a payment, or using our services, you (“Client”, “you”, or “your”) agree to be bound by these Terms. If you do not agree with these Terms, you should not proceed with a booking.

These Terms apply to all individuals, businesses, organisations, and representatives engaging our services unless a separate written agreement has been signed.

2. Services

Dubai Fotographer.com provides professional photography and videography services across the UAE, including but not limited to:

  • Corporate photography and videography
  • Event photography and videography
  • Wedding photography and videography
  • Fashion and lifestyle shoots
  • Product photography
  • Real estate photography and videography
  • Drone photography and videography
  • Commercial video production
  • Social media content creation
  • Editing and post-production services

The specific services, deliverables, pricing, timelines, and requirements for each project will be outlined in the booking confirmation, quotation, or proposal provided to the Client.

3. Booking and Confirmation

A booking is considered confirmed only after:

  • Acceptance of the quotation or proposal.
  • Payment of any required deposit; and
  • Written confirmation from the Company.

The Company reserves the right to decline or cancel a booking before confirmation if availability, operational limitations, safety concerns, or regulatory restrictions prevent the project from proceeding. Until a booking is confirmed, requested dates and times remain available to other clients.

The Client is responsible for reviewing all booking details and notifying the Company of any errors or changes as soon as possible.

4. Pricing and Payments

All prices are quoted in UAE Dirhams (AED) unless stated otherwise. A deposit may be required to secure a booking date. Deposits are generally non-refundable unless otherwise agreed in writing. The remaining balance must be paid according to the payment schedule provided in the booking confirmation or invoice.

The Company reserves the right to withhold delivery of photographs, videos, edited content, or any other deliverables until all outstanding balances have been paid in full. Additional charges may apply where:

  • The scope of work changes after confirmation.
  • Additional shooting hours are requested.
  • Additional editing or revisions are required.
  • Travel, accommodation, permits, or special equipment become necessary.

Late payments may result in project delays, suspension of services, or additional administrative fees where permitted by law.

5. Client Responsibilities

The Client agrees to provide all information reasonably required to perform the services effectively. The Client is responsible for:

  • Providing accurate booking details.
  • Ensuring access to venues and locations.
  • Obtaining any required permissions, approvals, permits, or licences.
  • Coordinating with venue operators, security personnel, or property owners where necessary.
  • Ensuring participants arrive on time.
  • Providing a safe working environment for Company personnel.

The Company is not responsible for delays, interruptions, reduced coverage, or additional costs caused by inaccurate information, venue restrictions, late arrivals, lack of access, or failure to obtain required permissions.

Where the Client requests specific shots, styles, or creative direction, reasonable efforts will be made to accommodate those requests. However, the Company cannot guarantee every requested image or scene due to environmental, timing, safety, technical, or logistical limitations.

6. Cancellations and Rescheduling

The Company understands that plans may change. If the Client cancels a confirmed booking, any deposit already paid may be retained to cover scheduling, planning, and administrative costs.

Where cancellation occurs shortly before the scheduled date, the Company may charge additional fees reflecting work already completed or resources allocated to the project. Rescheduling requests will be accommodated where reasonably possible and subject to availability.

The Company reserves the right to reschedule services where necessary due to circumstances including but not limited to:

  • Severe weather conditions
  • Safety concerns
  • Equipment failure
  • Government restrictions
  • Regulatory requirements
  • Force majeure events

Where a project cannot proceed for reasons outside the Company’s reasonable control, both parties will work in good faith to arrange an alternative date.

7. Delivery of Content

Estimated delivery timelines will be communicated before or during the project. Delivery times may vary depending on:

  • Project size.
  • Editing requirements.
  • Seasonal workload.
  • Client feedback timelines.
  • Technical requirements.

All delivery dates are estimates and should not be interpreted as guaranteed deadlines unless expressly agreed in writing. Deliverables may be provided through cloud storage platforms, online galleries, file transfer services, or other digital delivery methods chosen by the Company.

The Client is responsible for downloading and securely storing delivered files. While the Company may retain copies for a period of time, long-term storage is not guaranteed.

8. Revisions and Editing

Professional editing is performed according to the Company’s creative standards and style. Unless otherwise agreed, projects include a reasonable number of minor revisions.

Revision requests must be submitted within the timeframe specified by the Company after delivery. Additional revisions, extensive changes, re-editing requests, or alterations outside the agreed scope may incur additional charges. 

The Company reserves the right to decline revision requests that substantially alter the original creative direction or require work beyond the agreed project scope.

9. Copyright and Usage Rights

All photographs, videos, footage, graphics, edits, and other content created by the Company remain the intellectual property of Dubai Fotographer.com unless otherwise agreed in writing. Upon full payment, the Client receives a non-exclusive licence to use the final delivered content for the intended personal or business purposes discussed during booking.

Unless expressly authorised in writing, the Client may not:

  • Resell Company content
  • Transfer ownership to third parties
  • Claim authorship of the work
  • Modify content in a manner that damages the Company’s reputation.

Raw files, unedited footage, project files, source files, and working materials remain the property of the Company and are not included unless specifically stated in writing.

The Company may use completed work for portfolio, marketing, promotional, educational, website, social media, and business development purposes unless a written confidentiality agreement or prior restriction has been agreed.

10. Drone Services

Drone services are subject to UAE laws, aviation regulations, airspace restrictions, and permit requirements. The Company will only conduct drone operations where legally permitted and safe to do so.

Drone flights may be restricted, postponed, modified, or cancelled due to:

  • Weather conditions
  • Airspace restrictions
  • Government regulations
  • Safety concerns
  • Permit limitations

The Company cannot guarantee specific aerial shots where operational restrictions exist. Clients are responsible for assisting with any location-specific permissions required from property owners, event organisers, or venue operators.

11. Limitation of Liability

The Company will perform services with reasonable skill, care, and professionalism.

However, to the fullest extent permitted by applicable law, the Company’s total liability arising from any claim related to its services shall not exceed the amount paid by the Client for the specific project giving rise to the claim.

The Company shall not be liable for:

  • Indirect or consequential losses
  • Loss of profits or business opportunities
  • Delays caused by third parties
  • Venue restrictions
  • Weather conditions
  • Traffic delays
  • Regulatory restrictions
  • Technical issues beyond reasonable control
  • Client failure to provide accurate information

While the Company maintains backup procedures and professional equipment, no recording method is entirely risk-free. In the unlikely event of equipment failure, file corruption, accidental loss, or circumstances beyond reasonable control, liability shall remain limited as stated above.

12. Third-Party Services

The Company may use third-party platforms, software, cloud storage providers, music libraries, editing tools, and delivery services as part of project execution. The Company is not responsible for interruptions, outages, policy changes, or service failures caused by third-party providers.

Where licensed music, graphics, or other third-party assets are used, usage rights remain subject to the terms imposed by the respective licensors.

13. Events Beyond Our Control 

Neither party shall be liable for delays or failures caused by events beyond their reasonable control, including natural disasters, government actions, public emergencies, civil unrest, transportation disruptions, utility failures, pandemics, or severe weather events.

Where such events occur, both parties will work together in good faith to reschedule or modify the affected services where practical.

14. Changes to These Terms

The Company may update these Terms from time to time to reflect changes in services, business operations, legal requirements, or industry practices. Updated Terms become effective once published on the Company’s website.

Continued use of the Company’s services following publication of updated Terms constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates. Any dispute arising from these Terms or the services provided by Dubai Fotographer shall first be addressed through good-faith discussions between the parties.

If a resolution cannot be reached, the matter shall be submitted to the competent courts of Dubai, United Arab Emirates, which shall have exclusive jurisdiction.
